1. Agreement to Terms

By accessing or using Ag Alerts ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

Ag Alerts is an agricultural opportunity notification service that helps Canadian farmers discover grants, rebates, and funding programs relevant to their operations.

2. Description of Service

Ag Alerts provides:

• Free Search Tool: A publicly accessible search feature allowing users to find agricultural funding opportunities by province and farm type.
• Free Alert Service: Email alerts notifying registered users of new opportunities matching their specified criteria. Registration requires only a valid email address.
• Paid Pro Subscription: For a monthly fee, downloadable PDF reports of matching programs and printed summaries mailed to the subscriber.

The Service aggregates publicly available information from government websites and other official sources. We do not guarantee the accuracy, completeness, or timeliness of any information provided.

3. Eligibility

To use the paid Pro subscription, you must:

• Be at least 18 years of age
• Be located in Canada
• Have a valid email address
• Have a valid payment method

The free search feature is available to all users without registration. The free alert service requires only a valid email address.

4. Subscriptions and Payment

4.1 Pricing

The current subscription price is $12 CAD per month. The subscription includes optional email alerts for new programs and an optional printed monthly report mailed to you. Prices are subject to change with 30 days notice to existing subscribers.

4.2 Billing

Subscriptions are billed monthly through Stripe, our payment processor. Your subscription will automatically renew each month until cancelled.

4.3 Refunds

We do not offer refunds for partial months. If you cancel your subscription, you will continue to receive alerts until the end of your current billing period.

4.4 Cancellation

You may cancel your subscription at any time by:

• Using the cancellation link on our website at agalerts.ca/cancel
• Emailing us at support@agalerts.ca

5. Use of AI Technology

Ag Alerts uses artificial intelligence to help parse and categorize farm descriptions for the search feature. By using the AI-powered search, you acknowledge that:

• AI suggestions are provided for convenience and may not be perfectly accurate
• You should review and verify any AI-generated categorizations
• The AI does not store or learn from your specific farm information

6. User Responsibilities

You agree to:

• Provide accurate information when subscribing
• Not use the Service for any unlawful purpose
• Not attempt to interfere with the proper functioning of the Service
• Not use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce
• Verify eligibility requirements directly with program administrators before applying to any opportunity

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The information provided will be accurate, complete, or current
• The Service will be uninterrupted or error-free
• Any opportunities listed will be available or that you will qualify for them
• Results obtained from using the Service will meet your requirements

Ag Alerts is an information service only. We are not affiliated with any government agency and do not guarantee funding or program acceptance. Always verify program details, eligibility, and application deadlines directly with the program administrator.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AG ALERTS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Missed funding opportunities
• Costs of obtaining substitute services

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Ag Alerts and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Intellectual Property

The Service, including its design, features, and content created by Ag Alerts, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Information about government programs displayed on the Service remains the property of the respective government agencies and is used for informational purposes only.

11. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time, with or without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

For material changes to these Terms, we will provide notice to subscribers via email at least 30 days before the changes take effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which Ag Alerts operates, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
